  1. Introduction

1.1 We are committed to safeguarding the privacy of our clients, agents as well any

website visitors disclosing personal information to us; in this policy we explain how we

collect, treat, safeguard and delete personal information.

2.1 When making a booking at arctic Cruises we collect the following personal

information:

  • Full name as it appears in their passport.
  • Date of birth
  • Nationality (according to the passport they travel on)
  • Any personal/medical conditions which you deem to be important

to the enjoyment of the tour.

  • Phone number
  • This information is entered into our booking system and we may disclose your personal

information to any of our employees, insurers, professional advisers, agents, suppliers or

subcontractors insofar as reasonably necessary.

We will NEVER, without an express consent, supply any personal information to any third

party for the purpose of their or any other third party’s direct marketing.

We may disclose your personal information:

(a) To the extent that we are required to do so by law;

(b) In connection with any ongoing or prospective legal proceedings;

(c) In order to establish, exercise or defend our legal rights (including providing

information to others for the purposes of fraud prevention and reducing credit risk);

(d) to the purchaser (or prospective purchaser) of any business or asset that we are (or

are contemplating) selling; and

(e) To any person who we reasonably believe may apply to a court or other competent

authority for disclosure of that personal information where, in our reasonable opinion,

such court or authority would be reasonably likely to order disclosure of that personal

(e) By e-mail to any of our agents, suppliers or subcontractors in order to process your

booking.

(ei) Data are not encrypted.

(eii) We might share your personal information with partners, suppliers and/or

subcontractors outside the European Union.

to help ensure that we comply with our legal obligations in relation to the retention and

3.3 Notwithstanding the other provisions of this Section, we will retain documents

(including electronic documents) containing personal data:

misuse or alteration of your personal information.

4.2 We will store all the personal information you provide on our secure (password- and

firewall-protected) servers.

4.3 All electronic financial transactions entered into through our website will be

protected by encryption technology.

4.4 You acknowledge that the transmission of information over the internet is inherently

insecure, and we cannot guarantee the security of data sent over the internet.

Terms and Conditions

These terms and conditions (“Agreement”) govern your use of the Arctic Cruises website (“Website”) and the purchase of tours offered on the Website. By accessing the Website and making a booking, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms and conditions, please refrain from using the Webs

  1. Booking and Payment:
  2. By making a booking through the Website, you acknowledge that you are at least 18 years old and have the legal capacity to enter into a contract.
  3. All bookings are subject to availability.  Arctic Cruises reserves the right to cancel or modify any booking at any time.
  4. Payment for the tours must be made in full at the time of booking unless otherwise stated.
  5. Prices listed on the Website are in the specified currency and are inclusive of any applicable taxes or fees.
  6. When booking the Traveler should input the names of each traveler for the booking and write each name correctly, Arctic Cruises will book flight tickets by using this names listed in the booking. The Traveler is responsible for the names that appear on his or her travel documents and bookings being identical to the full name that appears in the Traveler’s passport. If the Traveler discovers inconsistencies between the travel documents and his or her passport, the Traveler must immediately inform Arctic Cruises to this effect, who will then make efforts to remedy the error. If the discrepancy is attributable to the Traveler, any related expenses shall be defrayed by the Traveler. If remedial action is not possible, the Traveler cannot hold Arctic Cruises liable.
  7. Cancellations and Refunds:
  8. Cancellation and refund policies may vary depending on the specific tour and are outlined during the booking process.
  9. If a cancellation is permitted, refunds, if applicable, will be processed according to the specified refund policy.
  10. Responsibilities and Liabilities:
  11. The travel company acts as an intermediary between customers and service providers.  Arctic Cruises is not liable for any actions, omissions, errors, or negligence of these service providers.
  12. Arctic Cruises  is not responsible for any loss, damage, injury, or delay caused by factors beyond its control, including but not limited to natural disasters, weather conditions, or third-party actions.
  13. Customers are responsible for obtaining and carrying all necessary travel documents, including passports and visas, and complying with any customs or immigration requirements. If the Traveler fails to comply with the requirements concerning passport, visa, health formalities, specification of correct name on travel documents and inspection hereof, the rules concerning late showing and other rules and regulations, the Traveler cannot make any claims against the Organizer, the retailer or the sub-supplier of the package tour for the consequences, lack of conformity, inconvenience or losses which result from failure to comply with the Traveler’s general obligations.
  14. Limitation of Liability:
  15. In no event shall  Arctic Cruises  be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Website or the tours offered.
  16. Arctic Cruises ‘ total liability for any claim arising under this Agreement shall not exceed the amount paid by the customer for the specific tour giving rise to the claim.
  17. Intellectual Property:
  18. The Website and its content, including but not limited to text, graphics, logos, images, and software, are the property of Arctic Cruises and are protected by intellectual property laws. You may not modify, reproduce, distribute, or sell any part of the Website or its content without prior written consent from Arctic Cruises.

  20. Arctic Cruises respects your privacy and handles your personal information in accordance with applicable data protection laws and its Privacy Policy.
  21. Governing Law and Jurisdiction:
  22. This Agreement shall be governed by and construed in accordance with the laws of Greenland.
  23. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Greenland.
  24. Amendments:
  25. Arctic Cruises reserves the right to amend these terms and conditions at any time. The updated terms and conditions will be effective upon posting on the Website.
